Do You Have Power Of Attorney Settled For Your Estate Plan

Power of attorney is a legal document that gives someone else power to act on your behalf as if they were you. You can grant power of attorney (POA) in many different avenues of your life, but in an estate plan, power of attorney has a vital relevance.

At Griffin, Cain & Herbig, Attorneys at Law, PLLC, we are estate planning attorneys who help people plan for their future. We understand the challenges ahead and know you have a lot of choices to make. We can help you make them. We serve clients across Conroe and the Houston-The Woodlands-Sugar Land metro, and we are ready to get to work for you.

A Brief Guide To Power Of Attorney For Estate Planning

When talking about power of attorney for an estate plan, largely we’re referring to a durable power of attorney. In other aspects of your life, you may use a limited power of attorney to have a trusted individual negotiate on your behalf – such as in a home purchase. But in that case, when the negotiation ends, so does the power.

A durable power of attorney lasts through any of the normal circumstances that would end a non-durable power of attorney, such as becoming incapacitated. This is important because it allows you to select someone who can make decisions for you when you no longer can. In Texas, you can have two different roles:

  • Medical power of attorney
  • Financial power of attorney.

The medical power of attorney can make decisions about your medical care, and a financial POA is focused solely on the care of your estate, similar to that of a guardian or conservator. You can choose to have these powers with the same person or with different people. The choice is yours.

Powers Of Attorney Come Into Effect When You Can’t Act On Your Own

Setting up power of attorney is an important step in your estate plan because of the uncertainty of the future. You may end up in a place where you cannot make decisions for yourself. Giving a person you trust the ability to make decisions will take the burden off of your family. They’ll know you were prepared for this, and you prepared someone else to take the burden.

We get how difficult these choices can be. We’ll be with you the entire time and help you make the plan you’re comfortable with. Call us at 281-524-6979 or send an email using this form.
